URGENT UPDATE!!! Fellow HIBOA Members, Until now there has been no real enforcement of the Hawaii Smoking Ban. After 30+ months only one person has been arrested and no businesses prosecuted under the law. This primarily because there are no adopted Adminstrative Rules in place. That is about to change. The Governor's Office has passed the proposed rules to Public Hearing. If these rules get adopted we can all realize a complete turn of events and fortune. The Proposed rules are VERY HARSH on businesses and not individuals. We highly recommend you oppose these rules in oral or written testimony. Attached you will find Notice of the Public Hearing(pdf), The Draft Administrative Rules (pdf), and The Draft Rules with our commentary upon them (word.doc). We recommend you read the rules with comments and cite those issues in blue and make use of the commentary for your testimony. The Public hearing will be held Wed. August 12th, 3:00 pm at Room 16 of the State Capitol. Testimony can be submitted by email to: tobacco2@doh.hawaii.gov cc us at bill@ejlounge.com on any email testimony so we can orally testify at the hearing. Written Testimony can be submitted by mail to: Current draft Rules are available at: www.hawaii.gov/health/about/rules/admruleschange.html Currently we have the most draconian Smoking ban in the nation to date. By showing that these administrative rules are oppressive, inappropriate, contradictory and often illegal we can hopefully impede these rules again and force our legislature into a civil compromise. Please support our group and defend business rights. Let them enforce upon individuals who are smoking rather that upon businesses. Please pass this along to your constituents who smoke or staff that support our issue. Mahalo Bill Bill Comerford, Spokesman Hawaii Bar Owners Association |
